Tossup is operated by Oskar Lundin (“we”, “us”), a sole trader based in Sweden. These terms form an agreement between you and Oskar Lundin. If you do not agree with them, do not use Tossup.
1. Acceptance
By creating an account, buying prompt packs, or continuing to use Tossup, you agree to these terms. You must be at least 16 years old, or have the authority to accept these terms on behalf of the organisation you represent.
2. What Tossup does
Tossup lets you describe a topic and have an AI producer draft a quiz — questions, answer options, artwork and the banter between rounds. You can edit the result, then host it as a live session that other people join from their phones with a four-letter code.
Each account starts with 10 free AI prompts. Beyond that, AI generation is paid for with prompt packs, which are one-time purchases of a fixed number of prompts. Prompt packs are not subscriptions and do not renew.
3. Your account
You must give accurate registration details, confirm your email address, and keep your credentials confidential. You are responsible for everything that happens under your account. Tell us promptly if you believe it has been compromised.
4. Acceptable use
You must not use Tossup to:
- break the law, or facilitate fraud, spam or harassment;
- infringe anyone's intellectual property, privacy or publicity rights;
- generate or distribute illegal content, sexual content involving minors, deepfakes or impersonations of real people intended to deceive, hate speech, targeted abuse of a real person, or malware;
- attempt to jailbreak, prompt-inject or otherwise circumvent the safety limits, prompt accounting or technical limits of the service;
- probe, scan, overload or interfere with the service or its infrastructure, or scrape it by automated means;
- reverse engineer, resell, sublicense or redistribute the service.
Quizzes about people you know are squarely within the spirit of Tossup; quizzes designed to humiliate, dox or harass someone are not.
5. AI content: your inputs and outputs
You keep the rights you already hold in the prompts, briefs and images you supply, and you grant us a limited licence to host and process them solely to operate the service. You confirm you have the rights necessary to submit them.
You are responsible for your prompts, for how you use the generated questions and images, and for verifying that they are accurate and appropriate for your audience. As between you and us, you may use the output of your generations for your own quizzes, including at events you charge for.
AI output can be wrong, dated or invented, and identical prompts can produce similar output for different users. Tossup is entertainment software: do not rely on its output as factual, professional, legal, medical or financial guidance without your own checking.
6. Moderation and takedowns
We may filter or refuse generations, remove content, and restrict or suspend accounts that appear to breach these terms. If you believe content on Tossup infringes your rights, contact us with a description of the content, where it appears and the basis of your claim, and we will investigate and remove infringing material where appropriate. Accounts that repeatedly infringe will be terminated.
7. Payment, tax and cancellation
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, invoicing, tax and refund mechanics are governed by Paddle's Buyer Terms. Our own refund commitment is set out in our Refund Policy. Prices are shown before you pay and may change for future purchases; prompt packs you have already bought are unaffected.
8. Our intellectual property
We own Tossup and everything in it apart from your content: the software, the design, the Tossup name and branding, and the documentation. You get a limited, non-exclusive, non-transferable right to use the service as intended, for as long as these terms are in force.
9. Availability and warranties
We work to keep Tossup running but do not guarantee uninterrupted or error-free performance. Sessions depend on the network conditions in your room and on third-party AI providers. To the fullest extent permitted by law, the service is provided “as is” and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
10. Liability
To the extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, including lost profits, lost data or lost goodwill. Our total liability for any claim is capped at the amount you paid us in the 12 months before the claim arose. Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot be limited by law.
11. Your indemnity
You will indemnify us against claims, losses and reasonable costs arising from your content, your prompts and generations, your unlawful use of the service, or your breach of these terms.
12. Suspension and termination
We may suspend or terminate your access for material breach of these terms, non-payment, suspected fraud or a security risk, or repeated or serious policy violations. You may stop using Tossup at any time. When access ends, your quizzes and session history may be deleted after a reasonable export window; unused prompts have no cash value and are not refundable on termination for breach.
13. General
You may not assign these terms without our consent; we may assign them as part of a merger, acquisition or sale of the business. Neither party is liable for delays caused by events beyond its reasonable control. These terms are governed by Swedish law, and the courts of Sweden have exclusive jurisdiction, without prejudice to any consumer rights you have in your country of residence.
